Why your choice of agent matters more in Marbella than most markets
Marbella is a fragmented market. Six districts, 28 distinct sub-areas, and a wide spread of property types mean that an agent who covers "all of the Costa del Sol" is unlikely to give you meaningful advice on a specific neighbourhood. Local specialisation matters.
Spain also does not require estate agents to hold a licence. Anyone can operate as an agent. This makes the question of who you work with more consequential than in markets where professional regulation is mandatory.
What to look for in a Marbella estate agent
- Local specialisation
Does the agent focus on the specific district you are buying in, or do they cover all of Costa del Sol? Sub-area knowledge matters when price differences between adjacent neighbourhoods can exceed €1,000/m².
- Years in market
Marbella has seen boom and bust cycles. Agents with 10 or more years in the market have navigated both and understand how pricing behaves across different conditions.
- Market knowledge
A good agent can tell you what comparable properties have actually sold for — not just what similar properties are currently listed at. Asking prices and transaction prices are not the same thing. An agent with genuine market knowledge knows the difference.
- Buyer nationality experience
British, Scandinavian, and Dutch buyers make up the majority of foreign purchases in Marbella. An agent with experience in your buyer profile understands the legal, financial, and practical questions you are likely to have.
- Regulated or affiliated
RICS regulation (the UK standard) or membership in LPA — Leading Property Agents of Spain — signals professional accountability. Spain does not require agents to hold a licence, so voluntary affiliation with a recognised body carries weight.
Red flags to watch for
- Agents who cannot name actual transaction prices in the area you are buying
- Pressure to make an offer before you have had time to review comparable sales in the area
- Agents who "cover all of Marbella and the Costa del Sol" without meaningful sub-area specialisation
- Unusually high commission promises — the standard range in Marbella is 3–5%
The role of an estate agent in Marbella
Understanding what an agent actually does — and who they are working for — is the starting point for any property search in Marbella.
- Seller's agent
Most agents in Marbella represent the seller. Their job is to achieve the best price for the property owner, not to protect your interests as a buyer. This is not a conflict in itself, but it is worth understanding. A seller's agent will show you properties and guide you through the process, but their fee is paid by the seller — typically 3–5% of the sale price.
- Buyer's agent
A buyer's agent works exclusively for you. They search the market on your behalf, advise on fair pricing, and manage negotiations with the seller's side. In Marbella, this is less common but available. Fees vary: some charge a flat retainer, others charge 1–2% of the purchase price, payable on completion.
- What an agent has access to
Marbella does not have a single MLS (Multiple Listing Service). Most agents work from their own portfolio and a network of collaborating agencies. A well-connected local agent can access a much wider range of properties than their public listings suggest. It is worth asking directly how many agencies they collaborate with.
- What an agent costs
For resale properties, the seller pays the agent's commission — typically 3–5% of the purchase price plus VAT. As a buyer, you do not pay the agent directly. For new developments, the developer pays the agent. The only scenario where a buyer pays directly is when engaging a dedicated buyer's agent, or when an agent charges an upfront search fee.
- What an agent cannot do
An estate agent in Spain is not a lawyer and cannot provide legal advice. You will need an independent Spanish property lawyer (abogado) regardless of how good your agent is. Legal fees typically run to around 1% of the purchase price. Do not skip this step.
